These Terms are a legally binding agreement between you and SkyHawker ("SkyHawker", "we", "us", or "our"). The contracting entity depends on your region (see Section 19). They should be read with our Privacy Policy and Cookies Policy.

Agreement to Terms

By accessing our website, booking through us, or contacting our support desks, you agree to these Terms, the fare rules of the relevant travel suppliers (airlines, hotels, operators), and our policies. If you do not agree, please do not use the Platform.

Eligibility & Account Registration

  • You must be at least 18 and have legal capacity to enter binding contracts.
  • You agree to provide accurate, complete information for yourself and every passenger.
  • You are responsible for keeping your account credentials secure and for activity under your account.

Nature of SkyHawker's Services

SkyHawker is an independent travel agent and ticketing intermediary. When you book, we contract with third-party suppliers on your behalf. Our role is limited to presenting fares and inventory, transmitting confirmed bookings to suppliers, processing payments and issuing confirmations, and providing post-booking support within these Terms. Carriage, accommodation and tour obligations rest with the operating airline, hotel or operator.

Booking Process & Confirmation

A booking is confirmed only once payment is received and the supplier issues a ticket, voucher or confirmation number. Fares and availability are live and can change until ticketing. Names must exactly match the government ID or passport presented at check-in; you are responsible for the accuracy of passenger details.

Pricing, Fees & Taxes

5.1 All-inclusive price

The total shown at checkout is the full amount payable and includes the base fare, applicable government taxes and surcharges, and SkyHawker's service fee. You pay the full amount before a booking is confirmed.

5.2 Service fees

Service or convenience fees are always disclosed before payment. They are non-refundable once a booking is processed, except where you cancel within 24 hours of booking and the supplier's fare rules permit, or where a non-waivable consumer law requires otherwise.

5.3 Tax changes after booking

If government taxes change after your booking is confirmed but before travel, we will notify you in writing at least 7 days before any additional charge applies, and give you the option to cancel for a full refund if you do not accept it.

5.4 Pricing errors

If a price is displayed incorrectly due to a technical or typographical error, we may cancel and issue a prompt full refund. Where the error is solely ours, we will use reasonable efforts to honor the confirmed price or let you cancel for a full refund or proceed at the corrected price.

Payment Terms

Card payments are processed by secure, PCI-DSS compliant providers (Razorpay, Stripe, PayU); SkyHawker does not store your full card number or CVV. Refunds, where due, are returned only to the original payment method.

Security notice: SkyHawker staff will never ask you to transfer funds to a personal account, share an OTP or card CVV, or install remote-access software. Report any such request to security@skyhawker.com immediately.

Cancellations, Changes & Refunds

7.1 Supplier rules & your statutory rights

Cancellations, changes and refunds are governed by the supplier's fare rules, subject to your mandatory legal rights. Many tickets, prepaid hotels and packages are non-refundable after 24 hours of booking.

US Department of Transportation rights: For tickets bought in the US at least 7 days before departure, you may cancel within 24 hours of booking for a full refund. If a flight is cancelled or significantly changed, you are entitled to a prompt refund under applicable DOT rules, regardless of fare type. Indian and Canadian consumers keep all non-waivable rights under the Consumer Protection Act 2019 and applicable Canadian law.

7.2 Post-ticketing fees

Where a supplier permits a change or cancellation, we charge a post-ticketing service fee per passenger per ticket, in addition to any supplier penalty. These fees are non-refundable once the service is rendered.

7.3 Schedule changes

Airlines may reschedule, reroute or cancel flights. We will make reasonable efforts to notify you of material changes and help you find alternatives or a refund under the airline's policy and applicable law.

7.4 No-shows

We are not responsible for missed flights or no-shows. Refunds, if any, follow the supplier's policy and must be requested within 180 days of the missed date unless the supplier specifies a shorter period.

7.5 Refund timeline

Once a refund is approved by the supplier, we credit it to your original payment method within 15 business days of receiving cleared funds. If the supplier delays beyond 30 days, we will notify you.

7.6 Fare withdrawn before ticketing

If a sourced fare is withdrawn after payment but before ticketing, we will notify you within 4 hours and offer rebooking on the nearest equivalent fare at no extra cost (up to 15% of the original amount) or a full refund within 5 business days.

Flight-Specific Terms

Most airlines require segments to be used in sequential order. โ€œHidden-cityโ€ or โ€œback-to-backโ€ ticketing is prohibited where restricted by the airline and may result in cancellation without refund. You agree to indemnify SkyHawker for costs arising from fare-rule violations. Baggage, seat assignments and special service requests are governed by the operating carrier.

Hotel & Accommodation Terms

Hotel bookings are subject to the property's rules, including check-in/out times, deposits and ID requirements. Hotels may deny admission at their discretion. Where a hotel denies check-in for reasons outside our control, our liability is limited to sourcing comparable alternative accommodation (subject to availability) or refunding the booking amount.

Holiday Packages

Each package component is subject to the individual supplier's terms in addition to these Terms. Where one component is cancelled or modified by a supplier, we will use reasonable efforts to source a comparable replacement or offer a proportionate refund for the affected component. Bespoke or group packages (10+ travelers) require separate written confirmation.

Travel Documents, Visas & Entry

You are responsible for valid passports, visas, permits and health documents for your entire journey. We recommend checking your government's advisory and the destination's embassy. SkyHawker can offer general guidance but cannot provide legal or visa advice and is not liable for denied boarding or entry due to inadequate documentation.

User Responsibilities & Prohibited Conduct

You agree not to misuse the Platform, including by submitting false information, making fraudulent or speculative bookings, scraping data, interfering with security, or using the service unlawfully. Violation may result in account suspension, cancellation without refund, and legal action.

Intellectual Property

All content, trademarks, logos and software on the Platform are owned by or licensed to SkyHawker and protected by law. You may not copy, reproduce or use them without written permission. Report suspected infringement to ipr@skyhawker.com.

Privacy & Data

We process personal data under our Privacy Policy. For users in India, SkyHawker Private Limited acts as the Data Fiduciary under the DPDP Act 2023. Booking requires transmitting passenger and document details to airlines, hotels, governments and border authorities to fulfill your travel.

Data Breach Notification

If we become aware of a personal-data breach affecting you, we will notify you and the relevant authorities where required by law, including under the GDPR/UK GDPR and India's DPDP framework, and describe the nature of the breach, data affected, likely consequences and measures taken.

Limitation of Liability

SkyHawker acts as an intermediary and is not liable for operational failures, flight delays, hotel service defects, personal injury, property damage, or events caused by third-party suppliers. To the maximum extent permitted by law, our aggregate liability for any claim relating to a booking is limited to the service fee we charged on that booking. Nothing excludes liability that cannot be excluded under applicable consumer law.

Indemnification

You agree to indemnify and hold harmless SkyHawker and its affiliated entities, officers, employees and agents from claims, losses, damages, fines and legal fees arising from your breach of these Terms, your violation of supplier fare rules, or inaccurate information you provide.

Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, severe weather, pandemics, war, civil unrest, strikes, government action, supplier insolvency, or technical failures.

Dispute Resolution & Governing Law

Before any formal proceeding, contact us at disputes@skyhawker.com with a written description of the dispute, the resolution sought and your booking details. We will try to resolve it within 30 business days. The contracting entity and governing law depend on your region:

Nothing here limits Indian-resident Users, who keep their full rights under the Consumer Protection Act 2019. Our Grievance Officer will acknowledge a formal complaint within 48 hours and respond within 30 days, as required under the Consumer Protection (E-Commerce) Rules 2020.

Miscellaneous

If any provision is found unenforceable, the rest stay in effect. Our failure to enforce a right is not a waiver. These Terms, with the supplier terms, Privacy Policy and Cookies Policy, are the entire agreement for use of the Platform. We may update these Terms; the โ€œLast updatedโ€ date reflects the current version.
